Terms and Conditions
On our portal "fincahotels.com" (legally represented by Mundillo Hotels GmbH) various accommodation operators offer holiday accommodation for booking. Mundillo Hotels GmbH (hereinafter Mundillo Hotels) acts exclusively as an agent of externally organized individual services (eg hotel accommodations, car rental, flights) of different operators (service providers). Mundillo Hotels is neither a tour operator in the sense of Sections 651a et seq. BGB (German Civil Code) nor does it provide hospitality services or other additional related services.
When booking, the accommodation the contract concerning the service will exclusively be made between the traveler and the relevant service provider (hotel) through the brokered of mundillo hotels GmbH. Therefore, the following terms apply exclusively for our brokerage activities and have no influence on the conditions under which the mediated travel services take place. In this respect, reference is made to the provider's respective terms and conditions (hotels, car rental companies or airlines).
Service for travel customer free of charge / Fee for cancellation free of charge
Mundillo Hotels GmbH does not charge a booking fee for its travel agency services, neither as a one-off amount nor as a surcharge on the room rate.
In contrast to many tourism companies, Mundillo Hotels GmbH does not currently charge a fee for consultancy services. We only charge a fee of 30 EUR per booking for the processing of free cancellations of arranged accommodation, based on an agency agreement in accordance with § 675 BGB (German Civil Code), for our personal consultation and booking/cancellation processing and the costs incurred by us.
Requests / Bookings
By the booking request that may be made in writing, orally, by e -mail or online (book immediately), the customer is communicating an interest in travel agency services by Mundillo Hotels. Thereupon Mundillo Hotels provides an offer to the customer, with regard to the mediation of the accommodation service required by the customer. The submission of the offer will take place by e- mail, orally or through the online description on our website (book now).
With the acceptance of the offer, the customer commissions Mundillo Hotels to provide an accommodation contract from the submitted offer and to bindingly book for him and the other participants. The mere submission of an offer does not constitute a binding reservation. In the "online booking method" the acceptance of the offer by the traveler becomes valid by pressing the button "Book Now with obligation to pay".
The customer shall be responsible for himself or herself and for all other participants listed in the offer. In order to carry out this booking order, the customer must be at least 18 years old. The contract with the mediated service provider (hotel) is due to the booking confirmation, which Mundillo hotels shall send to the traveler in the name and on behalf of the service provider.
The cost indicated on fincahotels.com for the night has to pay the travelers directly with the hotel. All from the accommodation contract claims and obligations resulting exist directly and exclusively between the traveler and his chosen hotel.
Once the traveler receives a booking confirmation by e-mail from Mundillo hotels, a binding rooms´ booking comes into effect for the selected hotel. The room reservation is legally binding without additional booking confirmation by post. After booking, the booking confirmation is either displayed on the browser on the Internet and / or delivered by e-mail.
Due to technical uncertainties in the transmission of e-mails Mundillo Hotels can basically neither check nor guarantee the delivery of booking confirmations by e-mail. The effectiveness of the reservation remains unaffected thereof.
Payment / Obligation to pay
The terms of payment of the respective hotel apply, which are displayed with the offer or in the online booking process or are communicated to you upon conclusion of the contract. Depending on the hotel and the rate booked, a deposit (booking guarantee) of between 0-100%* of the total amount booked is due.
Advance payment for online bookings is possible by bank transfer immediately (Klarna), SEPA direct debit (ELV online), credit card (Visa or Mastercard) or maestro card. You can choose the payment method during the booking process. By using one of the payment methods offered, you grant Mundillo Hotels GmbH permission to forward your personal data to the respective payment provider for the purpose of the transaction. You enter the payment data yourself on the payment provider Six Payment Services page, to which you will be securely forwarded after entering your personal, address and contact data by clicking on "Book with obligation to pay".
The remaining amount or the full travel price must be paid directly at the hotel on arrival or departure if the booked rate does not provide for full advance payment.
*With certain tariff choice the full pre-payment of the entire travel price can result or with holiday houses and group reservations a graduation of the full pre-payment can result before arrival. Please note the payment instructions in the hotel profile, in the offer sent, in the online booking process or on your booking confirmation. For group bookings, separate payment conditions apply, which will be communicated to you with the offer.
Tariff „Non refundable rate“
In case of a "non refundable rate“ tariff, the travel price is due in advance and in full at the time of booking. Your payment obligation exists immediately when you click on " Book with obligation to pay" or immediately upon acceptance of an offline offer with rate selection "Non refundable rate". Your declaration of intent is legally binding with the booking. Subsequent changes or cancellation free of charge are not possible due to the tariff and do not release you from the obligation to pay the total amount booked.
By paying the total amount, which Mundillo Hotels GmbH accepts in trust in the course of the booking process for the accommodation, you grant Mundillo Hotels GmbH the irrevocable permission to forward the full amount paid by you to the service provider (hotel) for the purpose of the booking process. Mundillo Hotels GmbH is not liable for forwarded third-party money.
Room Rates / VAT
Unless expressly stated otherwise, the room prices shown are always per room per night, including breakfast and VAT currently applicable in the respective country.
On the online booking process, the current daily prices are always displayed, at which a stay can be booked on a selected date and for the selected number of persons in a certain hotel. Other price publications elsewhere on the website or in offers sent by e-mail cannot be invoked. If you select an alternative currency to the Euro, the prices will be displayed in the chosen currency without obligation for orientation purposes only. The translation is performed using the most up-to-date exchange rates possible. Payment by the traveller to the hotel may vary due to new exchange rates on the day of departure.
Hotel informations / Classification
The hotel informations are based on information provided by the respective hotel. The same applies to the usual classification according to stars (shown as suns). It should be noted that in other countries the bases for classifications are different from those in your country. For this reason, such information only provides a non-binding reference to the hotel standard. Mundillo Hotels has no influence on this information and therefore accepts no responsibility for the accuracy and completeness of the information provided by the hotels.
Change in Booking / Cancellation / No-Show / Delayed Arrival / Early Departure
In order to avoid any misunderstandings, the rebooking and cancellation of a booking made via fincahotels.com must always be made in writing via e-mail via Mundillo Hotels GmbH. The traveller undertakes to arrive in accordance with the booked service.
In case of rebooking, cancellation or no-show, the cancellation conditions of the respective service provider apply. In the event of late cancellation or early departure, the service provider shall charge the corresponding cancellation costs in accordance with published/notified cancellation conditions. In case of late arrival, the traveller is not entitled to a reduction of the originally booked price. With the booking you accept the conditions of the service provider. Please inform the accommodation in good time about your actual arrival time, especially if your scheduled arrival is delayed.
In case of late arrival on a later day, nights not used are to be paid in full. The "non-refundable rate" tariff cannot be cancelled free of charge at any time. In the event of cancellation or non-arrival, the service provider is entitled to charge any tourism taxes.
The traveler grants the service provider permission to charge the amount due to his credit card data, which may have been provided as a booking guarantee, if the credit card data must be deposited. The cancellation conditions can be viewed in the hotel profile under "Prices" (only for hotels without online booking function), as well as during the online booking process in the section "Available rooms and prices" and on the booking confirmation sent. Mundillo Hotels GmbH does not charge a processing fee for cancellations. Your obligation to pay for cancellations with costs remains unaffected. We do not charge any fees for the first rebooking (replacement booking). From the second rebooking (replacement booking) on we charge a 30 Euro handling fee.
When processing cancellations of arranged accommodation free of charge, we charge a fee of 30 Euro per booking based on an agency pursuant to § 675 BGB (German Civil Code).
Entry requirements
For entry into the travel countries offered by Mundillo Hotels GmbH, a valid identity card is sufficient for EU citizens, and a child's passport for children. Customers outside the EU are advised to enquire about the entry requirements of the destination country via their consulates.
Health-related entry requirements can change at any time. Please check with your authorities what the rules are in the destination country at the time of your intended arrival.
As an agent, Mundillo Hotels GmbH accepts no liability for information relating to passport requirements or health regulations. Where Mundillo Hotels GmbH publishes such information, Mundillo Hotels GmbH makes no representation or warranty as to the accuracy, completeness or timeliness of such information. The liability of Mundillo Hotels GmbH is excluded in this respect.
Objection and cancellation due to technical errors
Mundillo Hotels GmbH and the service provider have the extraordinary right to object to and cancel a booking made online at fincahotels.com within 24 hours after sending an automatically generated booking confirmation if the confirmed room price was obviously offered too low due to technical errors. Applying for a confirmed price is excluded in such cases.
Liabilty
All details in the hotel profiles and on the online booking form have been compiled with the greatest care. However, no liability can be assumed for any errors in data collection or data transmission, as all hotel information, in particular the prices displayed on the online booking route, is based solely on information provided by the hotels. Mundillo Hotels GmbH therefore accepts no liability for the accuracy, completeness and up-to-dateness of the content and data provided. In particular, the hotels or holiday home operators are solely responsible for information on prices and room availability. In this respect, the user expressly releases Mundillo Hotels GmbH from any liability in connection with information provided/transmitted by the hotel or holiday home operator. This also applies to misrepresentations of hotels or holiday home operators that lead to overbooking.
Mundillo Hotels shall not be liable for the services provision by the service providers, but only for the proper mediation of the services and for the due and proper fulfilment of the contract and for the proper Disclosure of the service provider's information to the guest. Mundillo Hotels GmbH is not liable for forwarded third-party money if the forwarding of third-party money is necessary due to the tariff. Mundillo Hotels GmbH is not liable for the availability of a hotel room or holiday home at the time of booking. Mundillo Hotels GmbH shall only be liable with regard to its brokerage activities for intent and gross negligence. Liability is generally limited to foreseeable, contract-typical damage. Mundillo Hotels GmbH does not assume any liability for slightly negligent breaches of duty, unless essential contractual obligations, life, health or body are affected or claims according to the Product Liability Act are affected.
Data transfer
Mundillo Hotels GmH uses external service providers for certain functionalities and services who process personal data on behalf of Mundillo Hotels GmbH. These service providers are contractually obliged within the scope of § 11 BDSG and DSGVO to process the data only according to the instructions of Mundillo Hotels GmbH and not to use them for their own purposes. This applies for example for processing of online bookings or sending of newsletters (of course only if you have explicitly agreed to this beforehand), the customer service, the hosting of our services, as well as the processing of payments (credit card). In such cases, information is passed on to these companies for further processing. These service providers may only use the data for the purposes specified by Mundillo Hotels and in accordance with the applicable data protection laws. Furthermore, the data is passed on to third parties in cases to clarify an illegal product use or if this would be necessary for legal action.
By booking accommodation, you authorize Mundillo Hotels to transfer your personal data, which you provide to us upon booking for the purpose of fulfilling the contract, to the accommodation operator (service provider).

Participation and exclusion of the online Offer www.fincahotels.com
For violations of these Terms and Conditions, Mundillo Hotels reserves the right at any time to exclude users from the future use of fincahotels.com. Such exclusion includes the erasure and blocking of personalization created by users ("Memory List").
Mundillo hotel reserves the right at any time and without prior notice to restrict, to modify or completely stop using fincahotels.com. A legal claim by the user on the use of fincahotels.com is excluded.
By registering at fincahotels.com, on request, you will be informed regularly by e-mail about news about fincahotels.com and current offers. Booking customers will automatically receive the newsletter. You can stop the receipt of the newsletter any time by clicking on the appropriate unsubscribe button in the newsletter. Mundillo Hotel reserves the right to temporarily or permanently exclude internet users from using and / or cancel availability inquiries or reservations, if under the e-mail address provided by the user, multiple availability inquiries or (fake-)bookings had been made in the past which then were not considered from the user.
Miscellaneous
Mundillo Hotels GmbH reserves all rights to use and exploit the published content on fincahotels.com. Copying, reprinting, redistribution, electronic archiving, transfer of data to other data carriers, even in extracts, or use for purposes other than those provided here is strictly prohibited and is only permitted with the consent of Mundillo Hotels GmbH.
The use of Mundillo Hotels GmbH websites and their respective contents is only for the personal and non-commercial enquiry of hotel room bookings. Automated queries are not allowed. All data material published on our websites is protected by copyright. Any duplication, especially by scraping (automated reading) is prohibited. It is also prohibited to misuse our data material, in particular queries of the Internet Booking Engine for commercial transmission, unless these inquiries are made within the framework of a contractually agreed cooperation with travel agencies.
The user of fincahotels.com will be notified of any changes to these terms of use on the homepage or by e-mail. If the user does not object to such changes within four weeks after publication of the notification, the changes shall be deemed to have been agreed.
EU Online Dispute Resolution

Disclaimer for Links
By judgment of 12 May 1998 the regional court Hamburg decided that by placing a link the owner of a website is responsible for the contents of "linked" pages on external websites. This can only be avoided, in the view of the court, when the owner explicitly him- or herself from such contents. Mundillo Hotels has set links to other internet sites whose contents are not in the sphere of influence of fincahotels.com and their operators. Therefore this applies to all links: Mundillo Hotels has no influence on the design and contents of third party internet web sites. Therefore, Mundillo hotels expressly dissociates itself from all external contents, even if fincahotels.com has set a link to these external websites.
Applicable Law / Place of Jurisdiction
All legal relationships between Mundillo hotels and the hotel / user / traveler are exclusively subject to the laws of the Federal Republic of Germany.
The place of jurisdiction is 12529 Schönefeld/Germany.
